What is Rental Law?

Rental Law regulates the responsibilities of the lessor and the lessee arising from the lease agreement and the disputes arising as a result of the lease agreement.

The lessor is the owner of the leased property.

The lessee is the person who has the right to use the leased property in return for paying the price agreed by the parties.

What is the Purpose and Scope of Rental Law?

Before 1 July 2012, the provisions regarding the Rental Law were regulated in the Law No. 6570 on the Protection of Real Estate Rentals and the Law of Obligations No. 818, while the provisions in two different laws were abolished and gathered under the Turkish Code of Obligations No. 6098. In addition, rental law is protected by some special laws apart from the Code of Obligations.

The lease agreement, which is a contract that gives the right to use, benefit and imposes a bilateral debt, is used very frequently in practice and brings many legal problems with it. Apart from the rents we know, such as Residence and Roofed Workplace Leases, there are a wide variety of lease agreements such as Financial Leases, Fleet Lease, Product Revenue Lease.

Conflicts that arise within the scope of lease agreements can generally be shown as the lessee’s failure to pay the rent, the lessee’s failure to vacate the leased place, the lessor’s need to use the leased place as a residence or workplace, or the termination of the lease agreement by the lessor in the event of the need for reconstruction or zoning.
