What is Personal Data Protection?

Protection of personal data; It is a system to protect personal data belonging to real persons. Basically; It is the binding of the transactions made by real and legal persons who collect, process, store and transfer personal data to certain rules.

In this framework, it is aimed to protect the constitutional rights of individuals. Protection of personal data; It includes the processing of the data within the conditions set forth in the KVKK and other special regulations, and criminal sanctions if the data is processed outside of its purpose.

What is KVKK?

The term “KVKK” is an abbreviation of the term “Personal Data Protection Law”. The Law No. 6698 on the Protection of Personal Data (“Law”) entered into force by being published in the Official Gazette on April 7, 2016. The law regulates many issues such as the general principles to be followed when processing data, personal data processing conditions, the obligation to inform the data controller and the rights of the data owner; It introduces regulations that companies and their employees should pay attention to.

What is the Scope and Purpose of KVKK?

With the law, it is aimed to prevent the unlimited and arbitrary collection of personal data, making it accessible to unauthorized persons, disclosing or violating personal rights as a result of misuse or misuse.

The Law, which aims to control the issue under which rules and under which conditions personal data can be processed, aims to prevent the unlawful processing of personal data by introducing control mechanisms for the processing of personal data. In addition, regulating the obligations of natural and legal persons processing personal data and the procedures and principles to be followed are among the objectives of the Law.

Pursuant to this article, the purpose of the Law is:

– To protect the fundamental rights and freedoms of individuals in the processing of personal data,

– To regulate (discipline) the obligations of natural and legal persons who process personal data and the procedures and principles to be followed,

– Protecting the privacy of individuals (privacy of private life),

– Ensuring personal data security,

In Article 2 of the Law, the scope of the Law is specified. According to this article, the Law will be applied to real persons whose personal data are processed, and to natural and legal persons who process this data fully or partially automatically or non-automatically provided that they are part of any data recording system.
