What is Enforcement and Bankruptcy Law?

Enforcement law is the area of law that deals with the debt of the debtor who cannot pay the debt, upon the request of the creditor, by confiscating movable and immovable assets by force of the state. Enforcement law; checks, promissory notes, policies, loans of individuals and companies. It ensures that the receivables arising from the reasons are collected by law. Although enforcement law is generally expressed as money collection; it also covers issues such as the evacuation and delivery of immovables, the delivery of movables, the execution or failure of a job, the execution of the writs regarding the right of easement, the delivery of the child and the establishment of a personal relationship with the child. Bankruptcy Law; is a legal process in which people or organizations that cannot pay their debts can request to get rid of some or all of their debts. Bankruptcy begins and is enforced in most jurisdictions, usually through a court process initiated by the debtor. Bankruptcy is not the only legal status that a defaulter can have. Therefore, the term bankruptcy should not be perceived as a synonym for “inability to pay”.

What are the Differences between Enforcement and Bankruptcy Law?

Enforcement law, deals with a part of the debtor’s assets and his responsibilities to several creditors. Bankruptcy law, on the other hand, is known as general enforcement and the debtor’s responsibility is against all his assets and all his receivables. Bankruptcy is comprehensive in terms of both assets and creditors. While bankruptcy law is only in question for merchants, enforcement law covers all debts.
