Criminal Law is one of the main branches of Public Law and it is an area of law that examines the structure of human behavior defined as a crime by law and envisages specific sanctions. The two basic elements of Criminal Law are crime and sanction.
As defined in the Penal Code No. 5237, the purpose of the Penal Code is; to protect individual rights and freedoms, public order and security, the rule of law, public health and the environment, public peace, and to prevent crime. In the law, the basic principles of criminal responsibility and the types of crimes, punishment and security measures are regulated in order to achieve this aim.
Law of Criminal Execution is the area of law that shows the principles regarding the execution of the sanctions imposed as a result of the criminal procedure. In this respect, the existence of unique conditions and rules caused it to be accepted as an independent branch of law. However, the law of execution is not completely separate from the criminal law.
Because, the law of criminal execution regulates the execution of criminal law sanctions. Because of the law of execution, punishments are applied in accordance with their purpose. In this respect, the achievement of the purpose of the punishment depends on the success of the execution regime. If there is no good execution regime, a good punishment and criminal procedure will be meaningless.
