Competition Law is a branch of law built on the rules established for the purpose of protecting competition in goods and services markets.
The purpose of the Law No. 4054 on the Protection of Competition (Law No. 4054), which forms the basis of the competition legislation in our country, is stated in the 1st article of the Law: “…the agreements, decisions and practices that prevent, distort or restrict competition in the goods and service markets and the power of undertakings that dominate the market. To prevent misuse and to ensure the protection of competition by making the necessary regulations and inspections for this”. Transactions within the scope of the Law for the realization of this purpose are grouped under three main headings as Articles 4, 6 and 7 of the Law. In this context, the Law No. 4054
– Article 4 refers to agreements, practices and decisions that prevent, distort and restrict competition between any undertakings operating in or affecting the goods and services markets within the borders of the Republic of Turkey.
– Article 6, the abuse of this power by the undertakings that are in a dominant position in the market,
– Article 7, on the other hand, deals with all kinds of legal transactions and behaviors in the nature of merger or acquisition, which will create a dominant position or strengthen an existing dominant position, and as a result, will significantly reduce competition.
